2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 103(1), 61(2), 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3 . The prosecution case , in brief is that informant namely, Anu devi alleged that on 26.07.2024 , this petitioner along with other co-accused persons and 5-6 unknown persons came at the house of the informant and resorted firing upon the husband of informant from desi katta as a result of which he died on way to the hospital.
4. Learned counsel for the petitioner submitted that petitioner is innocent and has committed no offence as alleged.
Patna High Court CR. MISC. No.45734 of 2025(4) dt.21-11-2025 2/3 Allegation is general and omnibus against this petitioner. No specific overt act is alleged against him. No incriminating material has been recovered from the conscious possession of this petitioner. Similarly situated co-accused person has already been granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 0.06.2025 in Cr. Misc. No. 34973 of 2025 . Petitioner is in custody since 29.07.2024 .
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Session Judge - XIII , Patna in connection with Ramkrishna Nagar P. S. Case No. 597 of 2024 on the following conditions:
"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below .
(2) If the petitioner tampers with the evidence or the
