JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 272 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016. Twenty bottles of country-made liquor were recovered from a tempo in which petitioner was a passenger. Submission is that the said excise item was not of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like
