15-09-2017 Heard Sri Gagan Deo Yadav, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 29-05-2017 in Deodha P.S. Case No. 39 of 2017 registered for offence under Sections 272/273 of the Indian Penal Code and Sections 30(a)/35(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

Learned counsel for the petitioner submits that petitioner has been made accused on an accusation of recovery of about 53 liters of Nepali country-made liquor. By way of referring to statement made in paragraph - 3 of the petition, he submits that petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Binod

Patna High Court Cr.Misc. No.42706 of 2017(2) dt.15-09-2017 2/2 Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge - II, Madhubani in connection with Deodha P.S. Case No. 39 of 2017.
