It is submitted by learned counsel for the petitioner that inadvertently, he could not appear before the Hon'ble Court when the case was called out, as the advocate clerk could not mark the case in the cause list and he also could not see the intimation given through message and the email. Hence, vide order dated
Patna High Court CR. MISC. No.49246 of 2022(2) dt.21-09-2022 2/2 18.07.2022, the case stood dismissed for nonprosecution. It appears that earlier also several adjournments were given to the learned counsel for the petitioner which gets reflected from the earlier orders passed by this Court which suggests that counsel for the petitioner is in habit of adjourning the case and lingering the matter for early disposal.
In that view of the matter, this Court is not inclined to restore Cr. Misc. No. 7491 of 2020 which stood dismissed for non-prosecution vide order dated 18.07.2022.
Accordingly, the petition stands dismissed.
