ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, who was the Branch Manager of Uttar Bihar Gramin Bank, Puraini Branch having functioned there till the month of October, 2013 i.e., 15.10.2013, is apprehending his arrest in connection with Puraini P.S. Case No.104 of 2014 for allegedly having committed the offence under Sections 467, 468, 471, 420 and 409/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the accused persons, named in the F.I.R., is that they have withdrawn the amount of loan from the Bank by showing forgery in K.C.C. and G.C.C. Schemes in the Bank in

Learned counsel for the petitioner submits that during the relevant period i.e., in the year 2014, the petitioner was not posted at Puraini Branch, rather one R.P. Bhagat was posted as Branch Manager and it was he who had disbursed the loan amount to certain persons. He further submits that the petitioner is not named in the F.I.R. and not even a single farthing towards the aforesaid loan was made during the tenure of this petitioner. He further submits that other similarly situated person, namely, one Manoj Mandal whose name subsequently figured, has been extended the privilege of anticipatory bail in Cr.Misc. No.1516 of 2016, vide order dated 12.1.2016.
He further submits that even the Branch Manager of Uttar Bihar Gramin Bank has been extended the privilege of anticipatory bail in Cr.Misc. No.17262 of 2015 and the petitioner's case being similarly situated also deserves a similar order by this Court and, therefore, prays for grant of anticipatory bail.
Patna High Court Cr.Misc. No.38935 of 2015 (3) dt.22-01-2016 3/3 from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pradip Kumar Choudhary, learned Judicial Magistrate, 1st Class, Uda-Kishunganj, Madhepura, in connection with Puraini P.S. Case No.104 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
