JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,325,326 and 504/34 of the Indian Penal Code.

The accusation is of making assault in the background of dispute with regard to plucking of fruit. It is alleged that the petitioner, his wife and daughter started assaulting the informant when the petitioner assaulted with farsa on the head but the informant received fracture injury on the right palm. It is submitted by the learned counsel for the petitioner that for the petty dispute the accusation has been levelled. It is further submitted that the petitioner is alleged to have assaulted on

Patna High Court Cr.Misc. No.38021 of 2015 (2) dt.21-09-2015 2/2 the elbow when the fracture injury was found on palm. Considering the nature of injury, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Chakai P.S. Case No. 54 of 2015 pending in the court of learned J.M. Ist Class, Jamui.

This application is disposed of with the aforesaid observation/direction.
