Petitioner being Panchayat Sachiv failed to submit folder relating to Panchayat Teacher within the stipulated period, on account thereof, instant case has been registered under Sections 409, 420 of the IPC.

Non-production of document would really attracts Section 409 IPC is a matter of concerned and in likewise manner, applicability of Section 420. Moreover, from Annexure-3, it is evident that out of fifteen folders fourteen have already furnished which the competent authority might have seen. Apart from this, petitioner happens to be under custody since 09.08.2016.

Patna High Court Cr.Misc. No.52563 of 2016 (3) dt.17-02-2017 Accordingly, petitioner Shyam Bihari Singh is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Tilauthu) P.S. Case No.350 of 2016.
