JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Kutumba P.S. Case No. 94 of 2010, registered for the offence punishable under Sections 147, 148, 323, 379, 504, 307, 302/149 of the Indian Penal Code, Section 17 of the C.L.A. Act and Section 27 of the Arms Act.
The case of the informant is that while he reached near his house many persons caught him from behind and took out his Nokia mobile, voter list, cash of Rs. 250/- and also started assaulting him.
The learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., there is no specific allegation against him, similarly situated co-accused person has already been granted bail by this Court by an order dated
Patna High Court Cr.Misc. No.37860 of 2017 (2) dt.10-08-2017 2/2 03.05.2012 in Criminal Miscellaneous No. 7425 of 2012 and there is a general and omnibus allegation against all the unknown persons.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Fast Track Court, VII, Aurangabad in connection with Kutumba P.S.
