JUSTICE ARUN KUMAR ORAL ORDER 03-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kadamkuan P.S.Case No. 117 of 2018 registered under Sections 379 and 411 of the Indian penal Code. It's a case of theft of a Scooty and later on during investigation stolen Scooty was recovered from the possession of the petitioner.

Submission is that recovery is not from the conscious possession of the petitioner and he was standing by the side of the road and has clean antecedent and is in custody since 01.03.2018.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Saurabh Kumar Gupta @ Chotu @ Sarvan Kumar Gupta @ Chotu is directed to be released on bail,

Patna High Court Cr.Misc. No.42717 of 2018(3) dt.03-08-2018 2/2 after framing of charge, upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Patna in connection with Kadamkuan P.S. Case No. 117 of 2018.
