The petitioner seeks anticipatory bail in connection with Belhar P.S. Case No. 22 of 2018 for the offences alleged under Sections 341, 323, 353, 354, 379, 504 and 506 of the Indian Penal Code.

The accusation is that on 02.02.2018 the informant, Babita Kumari Sinha, being the Headmistress of Primary School, Rangmatiya, Banka, was engaged in distributing the mid-day-meal amongst the children, at that time petitioner, who is the husband of Sudha Devi, Secretary of the School, came and made demand of register then the informant replied that she will give the register to the Secretary, when she will come, on which the petitioner started to create nuisance, abused the informant, slapped on her cheek and snatched away her earring.

No.40080 of 2019(2) dt.01-07-2019 2/2 The learned counsel for the petitioner submits that due to dispute between the informant and Sudha Devi, who is Secretary of the school, the present case has been lodged. Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case and nature of allegation, I do not find it a fit case for grant of pre-arrest bail.

The prayer for pre-arrest bail is rejected.

The petitioner is directed to surrender before the trial Court and pray for regular bail.
