JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 307, 420, 435 and 504/34 of the Indian Penal Code.

Allegation against the petitioner no. 1 is that he took Rs. 35,000/- from the informant but did not return. On demand, informant was abused and subsequently, petitioner no. 1 fired shot at the informant, who received fire arm injury on his left hand. Petitioner no. 2 set the informant's shop on fire. It has been submitted on behalf of the petitioners that they have falsely been implicated in the present case. From perusal of the injury report (Annexure-3) it would appear that injury is simple in nature. There is admitted enmity between the parties. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the

No.39840 of 2015 (2) dt.01-10-2015 2 / 2 court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur, in connection with Sahkund (Sajour) P.S. Case no. 95 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
