The petitioner seeks regular bail in connection with Deepnagar P.S. Case No. 285 of 2018 for the offences punishable under Sections 379 and 461 of the Indian Penal Code.
The allegation is regarding unknown miscreants having uprooted the ATM Machine and having taken the same along with them. The name of the petitioner is stated to have surfaced during the course of investigation and upon confessional statement made by the co-accused person. The learned counsel for the petitioner has submitted that neither any recovery has been made from the petitioner nor from his house. It is further submitted that similarly situated co-
Patna High Court CR. MISC. No.42471 of 2019(4) dt.20-12-2019 2/2 accused persons have already been granted bail vide orders dated 23.05.2019, 20.06.2019, 09.07.2019 and 06.11.2019 passed in Cr. Misc. Nos. 33924 of 2019, 37649 of 2019, 30191 and 49475 of 2019, respectively. Lastly, it is submitted that the petitioner is languishing in custody since 21.01.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 285 of 2018.
