JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 379, 353, 504, 506, 427, 283, 336, 337, 338, 448 and 447 of the Indian Penal Code.

The prosecution case is that 32 FIR named accused persons and 250-300 unknown including the petitioner assembled at the main gate of Sabour Agriculture University and thereafter proceeded to the resident of Vice-Chancellor. The informant being Officer I/c of the local police station on being received the information reached at the spot to pacify the mob when the mob pelted stones and damaged the police jeep causing injury to the police personnel.

Patna High Court Cr.Misc. No.37773 of 2015 (2) dt.18-09-2015 2/2 It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against the mob. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, similarly situated co-accused Sanjay Kumar Jha has been granted anticipatory bail vide Criminal Miscellaneous No.32894 of 2013. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Sabour P.S. Case No.83 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
