The petitioner apprehends his arrest in Kanhauli P.S. Case No. 91 of 2016 registered for the offences punishable under Sections 436, 476 and other Sections of the Indian Penal Code and under Sections 18(C), 27(b) (ii), 18(A), 18(B), 28, 36(A) (C) of the Drugs and Cosmetic Act.
On the basis of a complaint made by the Commandant, SSB a raid was conducted and huge quantity of drugs was recovered from the shop of the petitioner. It is alleged that the petitioner was running the medicine shop without proper license. Learned counsel for the petitioner submits that the shop does not belong to the petitioner. No spurious or expiry medicine was recovered but it appears that the petitioner was illegally selling medicines and he did not have any license for running the
Patna High Court Cr.Misc. No.19687 of 2017 (2) dt.06-07-2017 2/2 medicine shop.
Considering the facts aforesaid and the fact that the petitioner was running the medicine shop without license, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
