Petitioner seeks bail in Phulwari P.S. Case No. 33 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

Informant in his written complaint has stated that on 21.03.2017 at about 3:00 pm while he was returning on his motorcycle from his office being posted as Field Staff, four unknown persons on two motorcycles followed him and obstructed his way and snatched his mobile, Rs. 1,06,320/- alongwith the motorcycle.

It has been submitted on behalf of the petitioner that he is not named in the FIR. It has been further submitted that the name of the petitioner has surfaced in this case on the basis of

Patna High Court Cr.Misc. No.37754 of 2018(3) dt.10-09-2018 2/2 confessional statement of co-accused Vidyanand Sahni, who has already been granted bail. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 29.06.2017 in Criminal Miscellaneous No. 22712 of 2017 and 10.08.2017 in Criminal Miscellaneous No. 35024 of 2017. Petitioner is in custody since 22.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai, in connection with Phulwari P.S. Case No. 33 of 2017.
