The petitioner seeks bail in Asthawa P.S. Case No. 105/2016, registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-b)A and 26 of the Arms Act.

The petitioner was apprehended and from his possession motorcycle, two mobiles and loaded arms were recovered. It is submitted that the motorcycle and mobiles are not the stolen property. Motorcycle belongs to the friend of the petitioner and he has not lodged any case of theft. For recovery of arms petitioner has already remained in jail for more than six months and there is no case under Arms Act pending against the

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge VI-cum-Additional Chief Judicial Magistrate V, Nalanda at Biharsharif in connection with Asthawa P.S. Case No. 105/2016.
