====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 11-09-2018 Heard learned counsel for petitioners and learned counsel for the State.

Petitioners, who are in custody, seek bail in connection with K. Hat (Moranga) P.S. Case No. 606 of 2017 registered for the offences punishable under Sections 341, 323, 325, 302 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assaulting son of informant by hard and blunt substance on 19.08.2017. He was send to hospital where during treatment he died on 31.08.2017. FIR has been instituted on 01.09.2017 after 12 days of the occurrence. According to the postmortem report death is due to single head injury. Informant is not an eye witness.

Patna High Court Cr.Misc. No.37770 of 2018(3) dt.11-09-2018 2/2 Petitioners have no criminal antecedent. Charge-sheet has been submitted.

Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Moranga) P.S. Case No. 606 of 2017.
