The petitioner seeks regular bail in connection with Laxmipur PS case no. 92 of 2016 registered for the offences punishable under Sections 395 of Indian Penal Code. The case of the prosecution is with regard to 10-12 unknown accused persons having entered the house of the informant and committed dacoity.

A perusal of the impugned order shows that the learned trial court has recorded that the name of the petitioner surfaced when the accused Rohit Pandit, upon being arrested, confessed his guilt and disclosed the name of the petitioner. Learned counsel for the petitioner submits that firstly the petitioner is not named in the FIR, secondly the accused

No.30861 of 2017 (2) dt.06-07-2017 2/2 person on whose statement petitioner has been implicated in the present case has already been granted bail vide order dated 19.06.2017 passed in Cr.Misc. no. 18396 of 2017 and lastly the petitioner is languishing in judicial custody since 01.06.2017. It is further submitted that in other case where petitioner is coaccused, he has already been granted bail. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-III, Jamui in connection with Laxmipur PS case no. 92 of 2016.
