At the very outset, counsel for the petitioners submits that he does not want to press the application of petitioner no.4 against whom there is specific allegation of assault. The application of petitioner no.4, namely, Arman @ Sheikh Arman is permitted to be withdrawn. The application of the petitioner no.4 is dismissed as withdrawn for the present. The petitioners have stated in paragraph 3 that they have no criminal antecedent.
Considering the case of petitioner nos. 1, 2 and 3
Patna High Court Cr.Misc. No.27458 of 2017 (2) dt.06-07-2017 2/2 against whom there is no specific allegation of overt act and the fact that the genesis of the present case is the quarrel between the children of the family of the petitioners and the informant side, let the petitioner nos. 1, 2 and 3 namely, Farhad @ Sheikh Farhad, Emran @ Sheikh Imran and Manan @ Sheikh Manan be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Bettiah, West Champaran, in connection with Purushottampur P.S. Case No. 47 of 2016 on the condition that the petitioners will extend full cooperation in this case and will not, in any manner, tamper with the evidence or influence the witnesses.
