The petitioner seeks bail in Ishakchak P.S. Case No. 46/2019, instituted for offence under Section(s) 20 and 21 of NDPS Act.

It is alleged in the written report that on getting secret information that Rohit Kumar and Nishant Choudhary are residing in the house of one Chandrashekhar Jha on rent and they used to use and sell opium and smack with their friends, the police reached there and found four persons including this petitioner were sleeping in a room. They tried to run away but they were apprehended by the police. It is alleged that total 5.54gm opium has been recovered from possession of this

Learned counsel for the petitioner has submitted that aforesaid recovered opium is less than commercial quantity. Petitioner is in custody since 21.03.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur, in connection with Ishakchak P.S. Case No. 46/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
