2. The petitioners are named in the F.I.R. and apprehending their arrest in connection with Laherisarai P.S. Case No. 33/2026 registered for the offences punishable under Sections 318(4), 316(2), 351(2), 352 and 3(5) of the BNS.
3. As per FIR, husband of petitioner no. 3 namely Amit Kumar Singh entered into an agreement with informant for supply of coal to different brick kilns during the deal/business period, where husband of petitioner no. 3, alleged to cheat total sum of Rs.41,96,500/-.
4. It is submitted by learned counsel appearing on behalf of the petitioners that admittedly agreement qua business deal was with husband of petitioner no. 3 Amit Kumar Singh and for the reason that petitioner no. 3 is his wife and petitioner no. 1 and 2 are none but
Patna High Court CR. MISC. No.42188 of 2026(2) dt.06-07-2026 2/2 mother and wife of elder brother they were implicated with present crime in question. It is submitted that moreover the allegation is of civil in nature arising out of business transaction for which civil proceeding qua recovery may be initiated and as such lodging present criminal case is completely un-occasioned and unwarranted, which was filed only with harassing approach. Petitioner no(s). 1 and 2 claimed clean antecedent and petitioner no. 3 found involved in one more case, where she is on bail.
5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as allegation prima-facie suggests implication of petitioners being family members, where dispute arises out of business deal qua recovery of outstanding dues, accordingly all above-named petitioners, who are ladies, in the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Darbhanga/concerned Court, where the case is pending in connection with Laherisarai P.S. Case No. 33/2026, subject to the conditions as laid down under Section 482(2) of BNSS.
