The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.

According to F.I.R. during withdrawal of money from the ATM by the informant, his friends, namely, Prem Kumar and Mohit Kumar, cunningly exchanged the ATM card, which was subsequently misused and money was withdrawn. Prem Kumar and others stated that petitioner was also there. Submission of the petitioner is that he has got no criminal antecedent nor anything was recovered from the possession of the petitioner.

No.49328 of 2016 (3) dt.20-01-2017 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara/Successor Court in connection with Ara Nagar Police Station Case No.412 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
