Petitioner, who is in custody, seeks bail in connection with Kanti P.S. Case No. 210 of 2018 registered for the offence punishable under Section 363 of the Indian Penal Code, latter on converted under Section 364(A) of Indian Penal Code.
Informant in his written complaint has stated that on 29.04.2018 at about 12:30 P.M. his nephew namely Md. Aiyan age about 5 years was at his door and when he was not found then he searched and thereafter he came to know from the daughter-in-law of Md. Kalim that Md. Aiyan was seen going with a person on red colour Ranger cycle and thereafter
Patna High Court Cr.Misc. No.37488 of 2018(3) dt.10-09-2018 2/2 he searched him, but no trace was found.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. The F.I.R. was registered against unknown and petitioner has been arrested only on the basis of suspicion by the police. He has not been put on T.I.P. The boy was recovered and he has stated nothing against petitioner. No complicity of petitioner has been found in the case. He is in custody since 04.05.2018 and he has no criminal antecedent.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West) at Muzaffarpur in connection with Kanti P.S. Case No. 210 of 2018.
