JUSTICE AHSANUDDIN AMANULLAH

Patna High Court CWJC No.19133 of 2014 (3) dt.11-04-2016 ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) 11-04-2016 Heard Mr. Gopal Govind Mishra, learned Counsel for the petitioner, and Mr. Rajesh Prasad Choudhary, learned Counsel for the respondent Nos. 3 and 4. Heard also Mr. Sunil Kumar Singh, learned Counsel for the respondent Nos. 7 and 8. With the help of this writ petition, made under Article 226 of the Constitution of India, in the form of Public Interest Litigation, the petitioner has sought for a direction to the respondent authorities to declare the strike of 2014, organized by non-teaching employees of respondent Veer Kuwar Singh University, as illegal.

Learned Counsel for the petitioner submits that the strike, organized by non-teaching employees of respondent Veer Kuwar Singh University, is, now, over.

In view of the above, this writ petition does not survive and is, therefore, closed with liberty granted to the petitioner to approach this Court if such a situation arises. Before parting with the same, we, however, make it clear that if any strike by non-teaching employees of respondent Veer Kuwar Singh University is held, in future, and found to be not in accordance with law, serious disciplinary action shall be taken against persons concerned.

Patna High Court CWJC No.19133 of 2014 (3) dt.11-04-2016 With the above observations and directions, this writ petition shall stand disposed of.
