Petitioner seeks bail in Paroo P.S. Case No. 77 of 2017 registered for the offence punishable under Sections 147, 148, 149, 342, 323, 324, 307 and 302 of the Indian Penal Code. Informant in his written complaint has alleged that on 15.04.2017 at about 2:00 pm Navin and Sakindra Sahani were going on motorcycle to visit the site of thrashing and in the way they hit one She-goat near village Bhelaipur and nearby villagers assaulted both of them as a result of which Navin died and Sakindra Sahani became injured.

It has been submitted on behalf of the petitioner that allegation against the petitioner is general and omnibus and there is also no allegation of any specific overt act. Similarly

Patna High Court Cr.Misc. No.39508 of 2018(3) dt.31-08-2018 2/2 situated co-accused person has been granted bail by a coordinate bench of this Court vide order dated 07.02.2018 in Criminal Miscellaneous No. 235 of 2018 (Annexure-2). Petitioner has got no criminal antecedent and is in custody since 07.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, West, Muzaffarpur, in connection with Paroo P.S. Case No. 77 of 2017.
