The petitioner has filed the instant application for modification of the order dated 25.4.2022 passed in Cr. Misc. No. 57952 of 2021, whereby while granting bail to the petitioner in connection with Baliya P.S. Case No. 171 of 2021, the petitioner was directed to surrender in the Court below within a period of four weeks.

It is submitted by learned counsel for the petitioner that petitioner was not aware about grant of anticipatory bail and he could not file the bail bond in stipulated time and accordingly, the period of surrender has expired. Hence, the

Patna High Court CR. MISC. No.55579 of 2023(2) dt.25-08-2023 2/2 petitioner prays for extension of surrender period. It appears from order dated 25.4.2022, that petitioner was granted anticipatory bail but he did not comply with the order for more than a year.

In view of the causal approach adopted by the petitioner, in complying with the order of this Court, I am not inclined to grant extension of period to surrender. Modification application stands dismissed.
