JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, this petitioner ordered co-accused, Mantu Rai, to shot fire at Prem Kumar, brother of informant.

Learned counsel appearing for the petitioner submits that petitioner is order giver and specific allegation of firing is against co-accused, Mantu Rai, who has already been granted bail by this court vide order dated 07.06.2021 passed in Cr. Misc. No. 10735 of 2021. Petitioner claims clean antecedent and is in custody since 02.07.2021 and investigation in this case is complete.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Raghopur PS case No.83/2019.
