The petitioner seeks regular bail in connection with Ballia P.S. Case No. 338 of 2021 registered for the offence under Section 392 of the Indian Penal Code.

As per prosecution story, when the informant was going towards his in-laws house, the accused persons intercepted on the point of pistol and snatched his vehicle thereafter the FIR was lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case only the basis of mere suspicion. It is further submitted that petitioner was not named in FIR and Test of Identification Parade has not been done till

Patna High Court CR. MISC. No.41059 of 2022(3) dt.04-01-2023 2/2 now. During investigation, the name of the petitioner came into light and no any incriminating article has been recovered from conscious possession of the petitioner. The petitioner is languishing in judicial custody since 23.3.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ballia P.S. Case No. 338 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai.
