JUSTICE PRABHAT KUMAR JHA ORAL ORDER 22-06-2016 Heard Mr. Navin Prasad Singh, the learned counsel for the petitioner and Mr. Akhilesh Pandey, the learned counsel for the opposite party No.2.

The petitioner has filed this petition for cancellation of anticipatory bail granted to her husband, Sukhnath Kumar. It is submitted that her husband has already solemnized second marriage and he is not paying maintenance to her. The petitioner-wife has apprehension to be tortured by her husband. It appears that after considering the fact that after nine years of the marriage the wife filed this complaint petition and also on consideration that she is living with brother of opposite

Patna High Court Cr.Misc. No.40410 of 2015 (6) dt.22-06-2016 2/2 party No.2, opposite party No.2 was granted anticipatory bail. I do not find any ground for cancellation of bail granted to opposite party No.2 as he has not misused the privilege of bail nor tampered with the evidence.

Accordingly, the petition for cancellation of bail is dismissed.
