The petitioner is in custody since 11.08.2020 in connection with Sakir P.S. Case No. 46/2020 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 948.54 litres of foreign liquor has been recovered from the cattle shed of the petitioner. Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the cattle shed which is in joint family possession. It is further submitted that the petitioner has no criminal antecedents. Petitioner is in custody since 11.08.2020. In view of the aforementioned facts and
