Learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application of the petitioner, however, in the event if the petitioner surrenders before the learned Trial Court, the learned Trial Court without being prejudiced by the fact that petitioner was permitted to withdraw the anticipatory bail application, shall dispose of the case in accordance with its own merit keeping in mind that both sides assaulted each other and both sides received grievous injury and the issue giving rise to the occurrence was a trivial one. Accordingly, the present anticipatory bail application of the petitioner is dismissed as withdrawn.
