The petitioners seeks bail in Mehsi P.S. Case No. 64 of 2018 registered for the offence punishable under Sections 392, 120B of the Indian Penal Code and section 27 of the Arms Act.
Informant in his written report has stated that on 03.04.2018 at about 5:30 pm when he was proceeding towards bank to deposit Rs. 5 Lacs two unknown miscreants riding motorcycle stopped them and on the point of pistol looted Rs. 2,40,000/- from his custody and fled away.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.38292 of 2018(3) dt.23-08-2018 2/2 they are innocent and have been falsely implicated in this case. The name of the petitioners has surfaced on the basis of confessional statement of a co-accused Aditya. Except the confessional statement there is no incriminating material against the petitioners. Similarly situated co-accused person Lalan Kushwaha has been granted bail by a co-ordinate bench of this Court vide order dated 19.07.2018 passed in Criminal Miscellaneous No. 43514 of 2018.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Mehsi P.S. Case No. 64 of 2018.
