Petitioner seeks bail in a case registered for the offences punishable under Sections 376, 341 and 323/34 of the Indian Penal Code.
According to FIR, the petitioner established physical relation with the informant on false pretext that he would marry with her. When the informant was pregnant from the petitioner, he refused to marry with her.
Learned counsel for the petitioner submits that the Doctor has not found any sign of pregnancy. Age of the victim was assessed as about 18 years.
Since apparently, the consent of the informant was obtained by fraud, I am not inclined to enlarge the petitioner on bail in connection Banka (Mahila) P.S. Case No. 12 of 2020
Patna High Court CR. MISC. No.38386 of 2020(3) dt.23-03-2021 2/2 pending in the Court of learned Chief Judicial Magistrate, Banka/successor Court.
Hence, prayer of the petitioner for bail is refused. Learned Trial Court is directed to expedite the trial of the case.
