2. The petitioner who apprehend arrest in connection with G.B. Nagar P.S. Case No. 177/2024 lodged on 19.04.2024, for the offences punishable under sections 341, 323, 324, 307, 504, 506, 34 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the F.I.R. has been lodged against two named accused persons, including the petitioner. It is alleged that certain antisocial elements used to visit the house of the petitioner, as her son was allegedly associated with them. The informant opposed such activities, which led to a confrontation. It is further alleged that the
Patna High Court CR. MISC. No.43745 of 2025(2) dt.16-07-2025 2/3 petitioner, along with the co-accused Salman Siddique, caught hold of the informant's father, whereupon co-accused Salman Siddique stabbed him in the abdomen with a knife, causing him to fall unconscious on the spot.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case due to an ongoing land dispute between the parties. It is contended that the petitioner is a lady having no criminal antecedents. The only allegation against her is that she allegedly caught hold of the informant's father; no overt act of assault is attributed to her.
5. Learned APP for the State vehemently opposes the prayer for bail and submits that there is direct allegation against the petitioner.
6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with G.B. Nagar P.S. Case No. 177/2024, pending before the learned CJM, Siwan is hereby rejected.
7. However, if the petitioner surrenders before the Trial Court within six weeks from today, the Trial Court is directed to pass an order on his surrender-cum-bail application
