The petitioners, already in custody, seek bail in connection with Saraiya P.S.Case No. 84 of 2013 registered under Sections 304B/34 of the Indian penal Code.
Allegation in brief is that all accused persons used to torture the daughter of the informant for demand of dowry and ultimately they killed her by hanging to death. Submission is that petitioners are the father-in-law, brother-in-law and brother of the husband of the deceased and the police, after investigation, submitted first charge sheet only against the husband and continued investigation against these petitioners. Patna High Court Cr.Misc. No.33223 of 2017 (2) dt.20-07-2017 2/2 acquitted by the trial court after putting him on trial and now charge sheet has been submitted against these petitioners. Having considered the aforesaid facts and circumstances, the petitioners, namely, Suraj Paswan, Kali Devi and Shyam Kishore Paswan are directed to be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur in connection with Saraiya P.S. Case No. 84 of 2013.
