The petitioner apprehends his arrest for the offences alleged under Sections 30(A) of Bihar Prohibition and Excise Act, 2018, registered in connection with Bind P.S. Case No. 145 of 2019.

At the outset, learned counsel for the petitioner has submitted that co-accused Rabu Chaudhary having similar allegation was granted bail by a co-ordinate Bench of this court vide order dated 23.1.2020 in Criminal Miscellaneous No. 4374 of 2020 and in order to avoid disparity similar benefit should be granted to the petitioner.

Accordingly, in order to avoid disparity and the fact

No.38312 of 2020(2) dt.21-10-2021 2/2 that there is no direct allegation against the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the court below within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court below where the case is pending in connection with Bind P.S. Case No. 145 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

The petitioner shall also not leave the country without permission of the trial court.
