The petitioner seeks bail in Katihar (Town) P.S. case No. 144 of 2016 under Section 392 of the Indian Penal Code. The informant alleged that he withdrew Rs. five lacs from the SBI, Bazar branch and while he was going to market with one Sharad Gaur, two persons riding on a motor cycle came and snatched the bag containing Rs. 5 lacs and cheque book, Adhar card etc. and fled away.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. Rupees 49,000/- was recovered from the possession of the petitioner but the cash bears no sign or mark for identification and it cannot be said that the aforesaid cash was looted one.
Patna High Court Cr.Misc. No.43088 of 2016 (4) dt.16-12-2016 2/2 It appears from perusal of impugned order itself that CCTV footage shows participation of the petitioner in the robbery from the possession of the informant.
Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
