Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-a), 25(1A), 25(2-AA), 26, 35 of the Arms Act.

Allegation against the petitioner is that a lot of material meant for manufacturing of illegal firearm was recovered from the house of the brother of this petitioner Lalo Sharma. Submission is that the petitioner is in custody since 04.04.2016. However, the trial has not progressed which would be evident from the report of the learned Trial Judge at Flag-'R'.

Considering the period already undergone by the

Patna High Court Cr.Misc. No.50294 of 2017 (4) dt.02-01-2018 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhagwanpur Police Station Case No.75 of 2016, subject to the condition that the both the bailors shall be resident of the territorial jurisdiction of the court below having immovable property with further condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
