JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 01-07-2025 Heard learned counsel for the petitioner and Mr. Humayou Ahmad Khan, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kankarbagh P.S. Case No. 245 of 2025 instituted for the offence under Section 310(2) of the B.N.S., 2023.
3. The case of the prosecution is that the informant had a land deal with the accused persons, namely Raj Raushan and Nitish Kumar. It was agreed between them that they would meet at a place with one crore rupees in cash. At about 12 noon, his friend Rajiv Kumar and the accused persons Raj Raushan and Nitish Kumar were already present. It is further alleged that 8-9 unknown persons entered in the room, armed with pistol.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He also submits that the name of this petitioner has surfaced during the course of investigation. It has also been submitted that altogether Rs. 3,65,000/- were recovered from the house of the petitioner. He also submits that Annexure-P/2 is the bank statement of one Sunny Kumar, which goes to show that on 11.02.2025, two withdrawals of Rupees Five lakhs each were made. It is further submitted that Sunny Kumar is own cousin brother of the petitioner, who lives with the petitioner in the same house.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kankarbagh P.S. Case No. 245 of 2025, he
