The petitioner seeks bail in S.T. No.147 of 2016, arising out of Chanan P.S. Case No.42 of 2015 instituted for the offences under Sections 341, 323,325, 504,506 and 302/34 of the Indian Penal Code.

Earlier this Court vide order dated 5.2.2016 passed in Cr. Misc. No.56595 of 2015 rejected prayer for bail of the petitioner.

There is direct allegation against the petitioner and one Ashlam to have caused fire arm injury on the body of the deceased.

Perused the report of the Sessions Judge, Lakhisarai.

Patna High Court Cr.Misc. No.40945 of 2016 (3) dt.09-11-2016 It appears from the report that those persons who are outside the jail are not co-operating the proceeding before the court below.

Learned counsel for the petitioner submits that case of the petitioner should be separated and trial should be expedited. If petitioner files the said application the session's court will pass order in accordance with law. Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail at this stage. Accordingly the prayer for bail is rejected.
