This application for anticipatory bail arises out of Chausa P.S. Case No. 52 of 2018, disclosing offences, punishable under Sections 341, 323, 307, 504, 354, 427 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioners has taken a very fair stand and has informed this Court that four other similarly circumstanced co-accused persons have been allowed anticipatory bail by this Court, by various orders. It is alleged in the FIR that the named accused
Patna High Court CR. MISC. No.39363 of 2019(3) dt.19-08-2019 2/3 persons had forcibly taken away certain articles belonging to the informant for Holika Dahan.
It is being stated that the petitioners shall pay to the informant a sum of Rs. 2000/-for the loss caused to the informant by way of a good gesture.
Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M. Uda-Kishunganj, Madhepura in connection with Chausa P.S. Case No. 52 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
