Mr.Jagdhar Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 This is an application for grant of anticipatory bail in connection with Katoriya P.S. Case No.21 of 2018, disclosing offence under Section 394 of IPC.

Prosecution story is that while informant along with his two brothers was going on by motorcycle, four miscreants came and snatched the motorcycle and also Rs.15,000/- from the informant and Aadhar cards of his brothers. Petitioner is not named in the F.I.R.

Submission of the learned counsel for the petitioner is that except confessional statement of co-accused Pappu Yadav, there is nothing against him.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that investigation is still going on and as such, at this stage, petitioner does not deserve anticipatory bail.

No.42919 of 2019(2) dt.12-07-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail on the basis of materials available on record.
