JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273, 420, 34 of the Indian Penal Code and 47 of the Bihar Excise (Amendment) Act, 2016.

One Md. Tanveer Alam was caught by the police when a Pick up Van was intercepted and in huge quantity, Indian made foreign liquor was recovered from the aforesaid Pick up Van. The aforesaid Tanveer Alam disclosed the name of the co-accused Md. Shamsad, who managed to escape from there seeing the police party. Petitioner happens to be son of the aforesaid Md. Shamsad and admittedly, he is not named in the first information report.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Balrampur P.S.
