20-07-2017 Heard learned counsel for the petitioner. No one appears on behalf of the State.
Petitioner, in the present case, is seeking regular bail in connection with Teghra P.S. Case No. 245 of 2016 registered for the offence punishable under Sections 392/411 of the Indian Penal Code.
Learned counsel for the petitioner submits that the First Information Report is against unknown, however, the allegation is that, as disclosed in the First Information Report, while the informant was moving on his motorcycle towards Bhagwanpur, one black colour Passion Pro Motorcycle on which two persons were riding snatched away his bag in which there was a Canvas Tab of Micromax Company, some medicines, no
Patna High Court Cr.Misc. No.32719 of 2017 (2) dt.20-07-2017 dues diary, a bill book and a folder. The informant disclosed that two SIM Cards were there in the Tab which has been disclosed in the F.I.R. It is submitted that this petitioner was later on caught by police with looted articles of this case and a stolen motorcycle for which Town P.S. Case No. 469/2016 dated 09.10.2016 was lodged under Section 399, 402 of the Indian Penal Code and 25(1-b)26 & 35 of the Arms Act was registered. In the said case, a coordinate Bench of this Court has granted regular bail to the petitioner on 18.04.2017, vide Cr. Misc. No. 6154/2017. It is submitted that the petitioner was taken on remand in the present case since 12.12.2016, the investigation is complete and a chargesheet has already been submitted in this case also.
Considering the facts and circumstances of the case, since a coordinate Bench of this Court has already been granted bail to the petitioner in a similar matter and the petitioner is said to be on bail in the cases disclosed in paragraph-3, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the Smt.
