2. Petitioners apprehend their arrest in connection with Rampur P.S. Case No. 640 of 2024 dated 05.12.2024 registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 74, 352, 351(2), and the 3(5) of BNS.

3. The main submissions advanced by petitioners' counsel are that admittedly, there is a land dispute in between the petitioners and the prosecution party, three persons are said to have sustained injuries in the alleged occurrence but these injuries are superficial and have been opined to be simple in nature and further, there is no specific allegation against any of the petitioner.

4. Mrs. Suman Kumari Singh, learned APP appearing for the State, has opposed the bail prayer of the petitioners.

5. Considering the aforesaid submissions and mainly the statements of two independent witnesses mentioned in paras 7 & 8 of the case diary which shows that on the alleged date and time of occurrence both sides initially engaged in abusing each other, thereafter, an assault took place in between them and also taking note of the nature of the injuries sustained and coupled with the ongoing land dispute in between both the parties at the relevant time of the occurrence, this court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners above named in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Rampur P.S. Case No. 640 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
