The petitioner, who is in custody, seeks bail in connection with Turkauliya (Banjaria) P.S. Case No. 528 of 2017 registered for the offence punishable under Sections 365, 363/34 of the Indian Penal Code.
For an occurrence on 23.08.2017 FIR was lodged on 26.08.2017 i.e. after three days without there being any explanation for the delay. FIR was lodged against unknown. It has been alleged in the FIR that 2 1⁄2 years old son of the informant, who was playing at the Darwaja on 23.08.2017 at 4.00 PM and he became traceless.
It has been submitted by the learned counsel for
Patna High Court Cr.Misc. No.40828 of 2018(3) dt.21-08-2018 2/2 the petitioner that petitioner is innocent and is not concerned in any way regarding missing of the son of the informant. He has been arrested on suspicion only on 12.04.2018 since then he is in custody for no fault.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihar, in connection with Turkauliya (Banjaria) P.S.
