The petitioner seeks bail in Chainpur P.S. Case No. 365/2018, instituted for offence under Section(s) 364, 302, 201 and 34 of the Indian Penal Code.

It is alleged in the written report that this petitioner and other accused named in the written report took the son of informant near Jagdamba Bandh, but he did not return. In spite of search, son of informant could not be traced out. Thereafter informant raised suspicion against this petitioner and other accused persons for kidnapping his son with intention to kill him.

Learned counsel for the petitioner has submitted that during investigation dead body of son of informant was

Patna High Court CR. MISC. No.39043 of 2019(2) dt.28-06-2019 2/2 recovered from dam. Mere suspicion has been recovered against this petitioner. Petitioner has no criminal antecedent. Petitioner is in custody since 14.05.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Chainpur P.S. Case No. 365/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
