The petitioner is apprehending his arrest in connection with Beldaur P.S. Case No.141 of 2020, GR No.1750 of 2020 pending in the Court of learned ACJM-IV, Khagaria registered for the offence under Section 392 and 412 of the Indian Penal Code.

As per the prosecution case, three criminals armed with pistols who have also covered their faces stopped the informant at their gun point and looted money of Rs.1,20,950, two mobiles and one TVS motorcycle of the informant. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. It is further submitted that the name of the petitioner

Patna High Court CR. MISC. No.38403 of 2020(5) dt.01-11-2021 2/2 has figured on the basis of confessional statement of co-accused Mithun Kumar. He further submits that the petitioner has no concern with the said co-accused Mithun Kumar. However, learned APP for the State vehementally opposed the prayer for bail and submitted that there is sufficient material against the petitioner during course of investigation. In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
