Petitioner is in custody in connection with Agrer P.S. Case No. 23 of 2019 for the offence under section 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner has been made accused in this case only on suspicion, although his name was not mentioned in the FIR. There is only reference that husband of Chuman Devi was involved in the killing. The suspicion is on account of the fact that the deceased was beaten and confined by family members of the petitioner one year back but later on the dispute was compromised. Now the informant has suspected that due to the aforesaid reason, his son was killed and threw in the field

The informant suspects involvement of the petitioner on the ground that there was love affairs between the wife of the petitioner and the deceased prior to marriage. Learned counsel for the petitioner submits that no one has seen the occurrence.

Considering the fact that petitioner has no criminal antecedent, no one has seen the occurrence and only suspicion that the petitioner has eliminated the son of the informant on the ground that there was love affairs between wife of the petitioner and the deceased, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Agrer P.S.
