The petitioner is languishing in custody for the offences punishable under Sections 376/511/354B of the Indian Penal Code and Sections 8/12 of the POCSO Act in connection with Fatehpur P.S. Case No. 141 of 2020.

Allegation against the petitioner is of commission of attempt to rape against a minor girl. The victim is informant of this case. The victim has supported the FIR in her statement before the Magistrate under Section 164 Cr.P.C. with specific act committed by the petitioner.

Learned counsel for the petitioner submits that due to old enmity false allegation is there.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail.

Patna High Court CR. MISC. No.38607 of 2020(3) dt.12-04-2021 2/2 Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial as the petitioner is in custody since 02.07.2020.
